David Rohrbacher

Mr. Rohrbacher has practiced law with the firm since 1975. He received his undergraduate degree from Manchester College, a J.D. degree from the University of Toledo, and a M.B.A. from the Weatherhead School of Management at Case Western Reserve University. Mr. Rohrbacher is admitted to practice before the Supreme Court of Ohio, the United States District Courts for the Northern District of Ohio and the Eastern District of Michigan, the United States Court of Appeals for the Sixth Circuit, and the United States Supreme Court. He has represented individuals, insurance companies, risk management companies and self insureds in a broad variety of litigation and now represents a number of entrepreneurs and business owners in business and transactional matters.

Representative Matters:

Formed a new limited liability company for individuals with expertise in Homeland Security, corporate and individual security matters.

Represented prominent veterinarian in sale of his small animal practice, the formation of a private foundation for the care of large cats, and assisted him in establishing facilities for tigers rescued from private owners.

Formed new limited liability company for individuals who have developed a break though delivery system for emergency relief materials to be deployed following natural disasters.

Represented management shareholders in acquisition of manufacturing company and subsequent purchase of investors’ majority interest; negotiated and documented terms of investment in company by public company.

Represented startup weekly newspaper in formation, relationship with investors, and growth as newspaper became largest weekly in the state of Ohio.

Representative Cases:

Reid v. Sheller Globe, et al. – represented the husband and minor children of an individual who was struck and killed by an automobile while she was mowing her front yard, more than 30 feet from the roadway. The driver, after hitting her, drove home. Subsequent discovery established that the driver, a corporate executive, had consumed too many alcoholic beverages while being entertained by a supplier. We obtained a multi-million dollar structured settlement for our clients.

Martin v. Martin Bros. , et al. – represented minority shareholders in a trial to the court to set the value of their interest in a corporation after they objected to a merger. Received a verdict 60% higher that our pretrial settlement demand. Verdict upheld upon appeal.

Austin v. Karle – represented individual who made significant loans to her sister and brother-in-law, who asserted that the funds were not loans, but were equity investments in a business they formed that subsequently failed. Jury verdict for our client for full amount of loans, interest and attorney fees. Immediately after receiving the verdict, we successfully collected the entire judgment by levying against stock held by the defendants.

Coleman v. Sandoz Pharmaceuticals Corporation, et al. – defended pharmaceuticals manufacturer against allegation that its prescriptive medication caused plaintiff to suffer a stroke resulting in a permanent brain injury. Case was featured in national news. A side issue was certified to the Supreme Court of Ohio. After the Supreme Court of Ohio addressed the side issue, the case was settled within settlement authority provided by the client.
